If you received a notice of data security incident letter stating your personal information was potentially compromised in the Emmanuel College Data Security Incident that occurred approximately between April 21-27, 2023 (“Settlement Class”), then you my be eligible for benefits from this Settlement. To receive benefits, you must file a Claim.
To receive benefits from this settlement, you must submit a Claim Form by July 21, 2025.
You may submit a claim for any and all of the following benefits:
1. Documented Loss Payment: Reimbursement of actual, documented, unreimbursed losses resulting from the Security Incident (up to $5,000.00 in total), incurred on or after April 21, 2023. Losses include: (a) Any costs incurred from credit monitoring services or ordering copies of your credit report; (b) Late fees, declined payments fees, overdraft fees, returned check fees, customer service fees, and/or card cancellation or replacement fees; (c) Late fees from transactions with third parties that were delayed due to fraud or card replacement; (d) Unauthorized chargers on credit, debt, or other payment cards that were not reimbursed; (e) Parking expenses or other transportation expenses for trips to a financial institution to address fraudulent charges or receive a replacement payment card; (f) Costs incurred obtaining credit freezes; (g) Long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used); (h) Postage or gasoline for local travel; and (i) Other expenses that are reasonably attributable to the Security Incident that were not reimbursed.
2. Pro Rata Cash Payment: A pro rata cash payment up to a maximum of $350.00, which may be adjusted downward pro rata based on how many other claims are made.
3. Credit Monitoring: This service includes two years of the following: (i) real time monitoring of the credit file at all three bureaus; (ii) dark web scanning with immediate notification of potential unauthorized use; (iii) comprehensive public record monitoring; (iv) identity theft insurance (no deductible); and (v) access to fraud resolution agents to help investigate and resolve instances of identity theft.
To start your online claim form, you can find your Unique ID and PIN on the Notice that was sent to you. If you are unable to locate your Unique ID and PIN, please contact us by emailing info@ECSettlement.com. You will be asked to provide the Class Member’s full name and mailing address.
